Auto+ Performance (“AUTO +”)

These Automotive Directory Terms of Service (“Agreement”) govern the use of the Automotive Directory platform, related services, listings, subscriptions, and associated features operated by Auto+ Performance (“AUTO +”, “we”, “our”, or “us”).
By purchasing, creating, accessing, or using a directory listing or related service, you agree to be bound by these Terms of Service.
1. Directory Services
The Automotive Directory is a business listing and marketing platform designed to connect automotive businesses, suppliers, vendors, service providers, and industry professionals across various automotive sectors, including but not limited to:

- Collision Repair
- Dealerships
- Auto Repair
- Calibration Centers
- Motorcycle
- Heavy Duty Truck
- Automotive Services & Suppliers
Directory services may include:

- Business profiles
- Category and sub-category placement
- Website links
- Photos and media
- Search visibility
- Promotional placements
- Automotive Job Hub integrations
- Automotive Market integrations
- Events calendar integrations
- Social media promotions
- Homepage features
- Reporting and insights
- Additional future platform features
Auto+ Performance reserves the right to modify, improve, suspend, remove, or update platform features, services, pricing structures, packages, and functionality at any time.
2. Listing Approval & Editorial Rights
All listings are subject to review and approval prior to becoming publicly visible.
Auto+ Performance reserves the right, at its sole discretion, to:

- approve or reject any listing
- edit listing content for clarity, formatting, SEO, visibility, categorization, or platform consistency
- modify categories, tags, descriptions, or listing placement
- remove excessive keyword stuffing, misleading content, spam, or inappropriate material
- refuse or remove listings without explanation or refund
- suspend or terminate listings that violate these Terms
Submission of payment does not guarantee approval or continued placement within the directory.
3. Platform Integrity & Reputation
Auto+ Performance is committed to maintaining a professional, trustworthy, and high-quality automotive platform.
Auto+ Performance reserves the right to reject, suspend, limit visibility, unfeature, or permanently remove any listing, business, profile, or associated content at its sole discretion if a business is believed to:

- misrepresent products or services
- engage in fraudulent, deceptive, abusive, or unethical conduct
- create reputational harm to the platform
- receive repeated credible complaints
- violate industry regulations or laws
- engage in spam or misleading marketing practices
- misuse platform features or promotional tools
- behave in a manner inconsistent with the standards or reputation of the Automotive Directory
Featured placements, homepage visibility, highlighted listings, and promotional exposure are granted at the sole discretion of Auto+ Performance and are not guaranteed solely based on subscription level or payment.
4. Subscription Terms
Monthly Subscriptions
Monthly subscriptions automatically renew unless cancelled through the customer account portal prior to the next billing cycle.
Listings will remain active until the end of the paid billing period.
No refunds are provided for monthly subscriptions.
Annual Subscriptions
Annual subscriptions are paid fully upfront and automatically renew annually unless cancelled through the customer account portal prior to renewal.
Customers may request a full refund within five (5) business days of the initial annual subscription purchase.
After five (5) business days, all annual subscription payments become non-refundable.
If a subscription is cancelled, the listing will remain active until the end of the paid subscription term and will then be removed from the directory.
5. Failed Payments
Listings associated with failed, declined, overdue, disputed, or reversed payments may be:

- paused
- unpublished
- limited
- suspended
- removed from visibility
until payment has been successfully processed.
Auto+ Performance reserves the right to permanently remove listings associated with unresolved payment issues.
Discounted or complimentary Automotive Job Hub postings included with directory memberships are strictly limited to employment opportunities directly associated with the subscribed business account.
Job postings may not be used:

- on behalf of customers or clients
- for third-party businesses
- for staffing agencies or recruiters
- for unrelated subsidiaries or organizations
- for resale or transfer purposes
Example: If a company subscribes under “Jobber Auto Supply,” complimentary or discounted job postings may only be used for employment opportunities directly related to Jobber Auto Supply.
Auto+ Performance reserves the right to:

- revoke posting privileges
- remove job listings
- suspend integrations
- terminate directory benefits
- remove listings without refund

if misuse or abuse of these privileges is identified.
Auto+ Performance reserves the right to modify:
- pricing
- package structures
- subscription features
- promotional offerings
- listing benefits
- integrations
- advertising inclusions
- visibility opportunities
at any time without prior notice.
Existing active subscriptions will maintain their current pricing until renewal unless otherwise communicated.
Social media shoutouts, homepage placements, featured visibility, newsletter promotions, and similar promotional opportunities are subject to scheduling availability and editorial discretion.
Auto+ Performance does not guarantee:
- impressions
- clicks
- engagement
- leads
- inquiries
- sales
- search rankings
- visibility levels
- hiring success
- advertising performance
- business growth
from any directory listing or promotional service.
Timing, placement, reach, and visibility may vary.
Analytics, listing insights, reports, traffic data, and visibility metrics are provided on a best-effort basis using available platform and third-party data sources.
Auto+ Performance does not guarantee the completeness, accuracy, or availability of analytics or reporting information.
Customers retain ownership of their submitted logos, photos, videos, descriptions, and content.
By submitting content to the Automotive Directory, the customer grants Auto+ Performance a worldwide, non-exclusive, royalty-free license to:
- display
- reproduce
- resize
- edit
- optimize
- publish
- distribute
- promote
- market
submitted materials for directory, marketing, promotional, advertising, social media, and platform-related purposes.
Customers confirm they have the legal right to use and submit all uploaded content.
The Automotive Directory and all associated services are provided “as is” and “as available” without warranties of any kind.
To the fullest extent permitted by law, Auto+ Performance disclaims all warranties, express or implied, including but not limited to:
- merchantability
- fitness for a particular purpose
- non-infringement
- uninterrupted service
- listing performance
- search visibility
- advertising effectiveness
To the maximum extent permitted by law, Auto+ Performance shall not be liable for:
- indirect damages
- lost profits
- business interruption
- reputational damages
- loss of data
- advertising losses
- hiring losses
- consequential damages
arising from the use of the Automotive Directory or related services.
In all circumstances, Auto+ Performance’s total liability shall not exceed the total amount paid by the customer for directory services during the twelve (12) months preceding the claim.
The Automotive Directory may integrate or link with third-party services, websites, tools, software, payment providers, social media platforms, or analytics providers.
Auto+ Performance is not responsible for the availability, performance, accuracy, or actions of third-party services.
These Terms of Service shall be governed by and interpreted under the laws of the Province of Ontario and the applicable laws of Canada, regardless of the customer’s geographic location.
Any disputes arising from these Terms shall be subject to the jurisdiction of the courts located in Ontario, Canada.
Auto+ Performance reserves the right to update or modify these Terms of Service at any time.
Updated versions will become effective upon posting to the Automotive Directory website.
Continued use of the platform following updates constitutes acceptance of the revised Terms.
